1. Legal Content and Acceptable Usage: [^]

1.1 "Microlink Server" will not accept websites which contain warez, adult material, pornography, PHP Server Probing, hacking tools or information regarding hacking, phreaking, IRC Bots, Password harvesting/stealing or any other type of illegal material. If we find any of this material on your account we have the right to suspend (or terminate in extreme cases) your account without prior warning and no refunds will be given. We also reserve the right to pass on any contact details to a third party if required to do so by law.

1.2 We will not host anime, regardless of whether the content is copyrighted or uncopyrighted.

1.3 We will not allow any software, mp3's video files or other material for which you do not have permission to use from the copyright holder. We may decide to pass on your details to the copyright holder in question in extreme cases if this material is found on your account.

1.4 We advise you not to store content on your account which you are not licensed to use, for example copyrighted works. Please get permission before storing copyrighted works.

1.5 We will not host any material which could cause harm or injury to any persons and/or reputation of persons or companies.

1.6 Users found to be sending out unsolicitated emails or 'spam' will have their accounts suspended (or terminated in extreme cases) and will not be given a refund, and may be subject to an unlimited 'cleanup' fine, which will be calculated at our sole discretion.

1.7 We advise you not to resell hosting that we supply to you due to security reasons. If we find that users are reselling their webspace to other users, and security on your site is compromised, we will not be able to assist or provide support to you regarding restoring files or settings, or any legal action which may be taken against you. We do not provide any tools, scripts, packages or control panels for reselling any our services. If you do decide to provide space to other users, whether paid for or not, all content on your account is your sole responsibility.

1.8 We suggest that all users on all packages check how much of their monthly data transfer quota has been used. This can be checked from the main page of the Microlink Server Control Panel. If your site goes over its monthly data transfer allowance, and you have chosen to keep that particular account active from the Client Centre, we will start charging you for any additional data transfer used at the rate of £0.001 / $0.0018 / €0.0015 per one Megabyte used. We will allow a 30 MB leeway limit. The final fee will be displayed on the Client Centre and will require payment within 7 days. We will continue to charge you for data transfer overage until your monthly reset takes place, or until you temporarily suspend your account until your next monthly quota reset. You can choose to temporarily suspend an account immediately when it exceeds its data transfer allocation by changing your preferences in the Client Centre.

1.9 Accounts which create unnecessary server load and use extreme CPU usage may be suspended at Microlink Server's discretion if the offending accounts are causing a detremental effect upon other accounts on the Microlink Server network. Suspended accounts in this situation may not be able to be reactivated by us.

1.10 Users with access to CRON must not start processes which can cause a detremental effect to our network. Users found to be starting processes which use extreme amounts of CPU time such as running IRC Bots will have their accounts suspended immediately.

1.11 Users with access to SSH must not leave their home directory, or try to gain access to areas not authorised for them. All SSH activity is logged, and any users found to be violating these terms will have their accounts suspended immediately.

1.12 We will email you if you exceed your allocated webspace limit. We suggest that you upgrade your account if you exceed your webspace limit, or delete files within your account to bring your account back within it's allocated webspace quota. If you do not take action within 7 days of us contacting you we may suspend your account until you agree to either upgrade your account or delete files.

1.13 We reserve the right to delete or discuss alternative arrangements for any excessively large files on your account that may be using excessive amounts of bandwidth, or creating excessive CPU usage. We advise that you host any large files such as videos, MP3's or other large files on our file hosting service, which is specifically designed for this purpose.

2. Payments for Services, Cancellations & Refunds: [^]

2.1 At present we only accept payments via PayPal. We will not be responsible if you cannot pay for your services via PayPal, nor can we offer any alternative forms of payment. We expect all invoices to be paid within 7 days of them being issued, otherwise they will be suspended until payment has been received in full. Accounts which have not been re-activated (and paid for in full) within 30 days will be permanantly deleted without notice.

2.2 You may cancel your accounts or services at any time. If you cancel halfway through a month we will not refund any money to you, instead your account will remain active for the remaining duration that you paid for. We suggest that you cancel any accounts before your next billing cycle, otherwise we will charge you the full amount owed regardless of whether you are cancelling your account/service. You can change your renewal preferences from the Client Centre, and all new accounts are set to renew automatically.

2.3 Users with existing accounts/services can upgrade or downgrade packages at any time. Microlink Server will also refund the remaining equivilent cost of remaining time left on those packages against the cost of the package to be upgraded or downgraded to. Please note however we will not provide refunds if you are simply cancelling from the Microlink Server service altogether. It will be at Microlink Server's discretion to decide how much to discount upgraded or downgraded packages for existing users.

2.4 Our 30-day money back guarantee policy is only valid on initial signups for hosting packages, and will not be given on packages being renewed after their first expiry.

2.5 Our 30-day money back guarantee is not available to accounts which have broken any of these Terms of Service points stated on this page.

2.6 Our 30-day money back guarantee does not apply to domain names, Shoutcast servers, file hosting services or any setup fees involved with ordering any services we provide.

2.7 Cancellation of domain needs clear 60 days notice before it's expiery.


3. Data Protection and Stored Data: [^]

3.1 We may pass on your contact details to any law enforcement agency should we be required to by law, although we will attempt to contact you beforehand. However, we do respect our customers' privacy, and therefore will never pass on any of your details to a third party without your agreement beforehand.

3.2 Although we make every effort to protect your stored data, we will not be held responsible for any data that is lost, deleted or becomes corrupted whilst hosted on our servers. We suggest you make regular backups of your stored data and keep offline copies of all content that is uploaded to our servers.

3.3 We may email you from time-to-time about special offers and new services if you order one of our packages. Should you become an inactive customer for any reason we will stop contacting you.

3.4 We will always contact customers via the email address provided on the Client Centre, which is initially the email address used when ordering, and can be changed at any time from the Client Centre. We will not be held responsible for customers not receiving important information from us due to incorrect information. It is your sole responsibility to keep your contact details up-to-date at all times.

3.5 When ordering domain names, we will add your contact details to the global WHOIS database. For .uk domains, individuals can 'opt out' from the WHOIS database, therefore removing their contact details from public view. You must provide us with accurate and up-to-date contact details when ordering domain names.

4. Uptime Guarantees and Network: [^]

4.1 We cannot guarantee that all our services will be up 100% of the time, as from time to time we may carry out maintenance on servers on our network, or the network may be affected by factors out of our control, such as equipment failiure, high levels of traffic, denial of service attacks, strikes, natural disasters or acts of God. We cannot provide any refunds for downtime.

5. File Hosting Specific Terms & Conditions: [^]


5.1 Our file hosting service is designed for any excessively large files that you would like to distribute, rather than using our standard shared hosting packages. Our file hosting service is specifically designed for file hosting only, and will not allow any scripts or HTML files to be run.

5.2 We reserve the full right to suggest that large files hosted on shared hosting accounts are moved to our file hosting service should such files start causing a detremental effect on the performance of our shared hosting servers.

5.3 We will not host any illegal files on our file hosting service. You may host MP3's, videos and programs, so long as you are entitled to legally host such files. We reserve the full right to delete, move or question such files we think may be hosted illegally on our file hosting service, and we also reserve the right to contact the relevant authorities about such material if it is found on our file hosting service.

5.4 Any data transfer used over your quota on the file hosting service will be charged at £2.50 / $4.50 / €3.75 /INR 200.00 per additional GB.

6. Disclaimer [^]

6.1 Microlink Server, its staff and its affiliates will not be held liable for any loss of earnings, loss of business, lost opportunities or lost data or information. We will not offer any refunds or cashback to customers in cases where we cannot provide a service to you. We may provide a period of free hosting at our discretion in some extreme cases of loss of service.

6.2 Microlink Server reserve the right to amend these Terms & Conditions at any time, without notice to users. It will be the users responsibility to check this page regularly for amendments. Users who do not agree with the points stated above should either terminate their account with Microlink Server or refrain from signing up to any services provided by Microlink Server.
